1. Scope of Application

These Terms and Conditions ("Terms") govern the use of software developed and published by SmarterWaysProductions ("we", "us", "Provider").

Our software is distributed through Steam (Valve Corporation). The core software is available free of charge via Steam Early Access. Steam's platform terms, delivery, and refund policies are governed by Steam's Subscriber Agreement. These Terms apply to the usage of our software after you obtain it.

3. Product Description

We develop AI-powered desktop software that runs locally on your computer. Our products are designed to work offline after installation, ensuring your data stays on your device.

4. Third-Party AI Models

Andromeda serves as a platform for running third-party AI models. These models are not owned by SmarterWaysProductions and are subject to their own respective licenses (e.g., Apache 2.0, MIT, or community licenses).

By downloading, importing, or using any AI model within Andromeda, you acknowledge that:

  • You are solely responsible for complying with the license terms of each model you use
  • SmarterWaysProductions does not review, endorse, or assume liability for third-party model content or behavior
  • Model licenses may impose additional restrictions on commercial or governmental use

5. Availability and Delivery

Andromeda is available free of charge via Steam Early Access. By obtaining our software on Steam:

  • You agree to Steam's terms and conditions
  • The software is delivered directly to your Steam library
  • A free demo is also available on Steam
  • Optional paid add-ons (e.g. Supporter Pack, Pro version) are subject to Steam's Refund Policy

6. License and Usage Rights

By obtaining our software, you receive a non-exclusive, non-transferable license to use the software:

  • Permitted: Personal use on your own devices
  • Permitted: Commercial use on your own devices, free of charge up to an annual revenue of €200,000
  • Permitted: Installation on multiple personal devices linked to your Steam account
  • Commercial license required: If your business generates more than €200,000 annual revenue, a commercial license is required — please contact us directly to obtain one
  • Prohibited: Resale, redistribution, or sublicensing of the software itself
  • Prohibited: Reverse engineering (except as permitted by law)
  • Prohibited: Circumventing license protection

The license is tied to your Steam account. Violation of these terms may result in license revocation.

Statutory warranty provisions apply. The software must correspond to its product description on Steam.

  • Report defects to our support team
  • We will provide fixes or workarounds where possible
  • For purchase-related issues, Steam's policies apply

9. Limitation of Liability

We are liable only for:

  • Intent and gross negligence without limitation
  • Breach of essential contractual obligations (limited to foreseeable damages)
  • Personal injury according to statutory provisions
  • Claims under the Product Liability Act

Any further liability is excluded to the extent permitted by law.

Our software runs locally on your device. We do not collect personal data through the software itself.

11. Applicable Law and Dispute Resolution

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

We are generally willing to participate in consumer dispute resolution procedures.

12. Sanctions and Use Restrictions

The use of this software by governments, military institutions, state authorities, intelligence services, or other public institutions of countries subject to sanctions by the Federal Republic of Germany or the European Union (EU) is expressly prohibited. This applies to all direct and indirect forms of use.

Private, non-commercial use by civilian persons in these countries remains expressly permitted, unless prohibited by applicable export control laws or technical restrictions.

SmarterWaysProductions is not responsible for the end user's compliance with local import regulations.

13. Compliance with Applicable Law (EU AI Act)

You agree to use the software in compliance with all applicable laws and regulations, including but not limited to the European Union Artificial Intelligence Act (EU AI Act).

You are solely responsible for ensuring that your use of AI-generated content (e.g., labeling of AI-generated text or images) complies with the legal standards applicable in your jurisdiction. SmarterWaysProductions assumes no liability for non-compliant use of AI-generated outputs.

14. Final Provisions

Severability: If any provision of these Terms is invalid, the remaining provisions remain in effect.

Changes: We may update these Terms. Continued use of the software after changes constitutes acceptance of the updated Terms.
